I've had my I-140, I-485 pending since August 2007 in Nebraska and i just started getting worried recently when i found out that the job title in the I-140 does not match the job name in my labor cert.
My labor cert took 4 years to be approved and in the meantime my job changed. It is still in the same field/department, in the same company, but it just evolved but still requires the same skills as the labor cert.
I was originally on H-1B and now i work with my EAD. My H1B was amended when my job changed but not the labor cert since we were well into the process when all this happened.
This is really the only concern that i have regarding the approval of my I-140 and I-485. Do any of you know if the job name difference would be a problem for the I-140 to be approved? At the least i hope they would send me an RFE and not deny it right away.

I am on H1B visa, and now I am going to fly back to my home country. Unfortunately, I can't find the original left lower portion of my I797, which is "for personal record". I still have the orignial upper portion, I94, and copies of the whole I797 form.
Will I have trouble getting my visa stamp and reenterring this country? What should I do now?

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.

Hi,
I had an important query on the following scenarios/questions
Let's say one switches from H1B to EAD as part of either the same job or a different one , then
1 on EAD should the person be making more than the Prevailing wage as shown on his/her Perm labor certification?
2 If ppl on EAD do need to meet Prevailing wage for their position then are they ok to meet the prevailing wage from when the labor was filed or the most current prevailing wage from DOL for that position??

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

I was trying to know what are the possibility of those people who have ported successfully and still got their GC approved.
I realized that people who already got their GC won't be visiting this site. But, if you have known somebody who did, vote on the poll please.
1. Changed jobs --> interview --> got GC (no RFE)
2. Changed jobs --> RFE --> invoke AC21 --> interview --> got GC (invoke AC21 only when requested)
3. Changed jobs --> invoke AC21 --> interview --> got GC (invoke AC21 voluntarily, but no more RFE)

Hi,
Following are my USA stay details on L1 and H1-B visa:-
1) Stayed in USA from 01-SEP-2003 till 25-JAN-2004 on L1 visa(expired now).
2) Stayed in India from 26-JAN-2004 till 01-NOV-2004.
3) Stayed in USA from 02-NOV-2004 till date on new H1-B visa(still valid).
I read somewhere that 6 year period for H1 also counts L1 stay. Can someone please suggest, what should be my H1's final expiry date based on above details? Will that L1 stay be counted, even though I went back to India and came on a new H1-B visa?

I have a Masters degree in the profession I'm working with 2 yrs of work exp prior to starting at this company. Altogether I have 5+ yrs of exp (prior + current).
My job requirements states "BA/BS or equivalent required with 5+ yrs of work exp".
I've read at some sites that if a candidate doesn't have a Masters degree, a Bachelor's + 5 yrs of exp will suffice, but the job description should require a Master's degree. In this case, I have a Master's degre with my job requirement saying "Bachelor's + 5yrs". Will I qualify for EB2? Please suggest.
Also what other options (tweaking requirements a bit) will you suggest?

is it possible and advisable to convert H1 B to H4 and go on searching for job and if find a job then coming back to H1? Are there any risks in this process? if so can some one explain me in detail?
Yes you can switch from H-1b to H4 status. later on when the prospective employer finds a new job for you then that they can file a change of status application from H4 to H-1b under non cap case.

I am an Indian, currently working in Saudi Arabia. Just paid my IV fee to NVC, and waiting for Package-3. As far I understand regards to Police Clearance Certificate, I need to get Police Clearance from
1. Indian embassy from Saudi Arabia (as Saudi PCC are not available for third country citizen residing in the kingdom) and
2. Local and District police stations from India, where I stayed more than 06 months.
As per Indian embassy web site to apply for PCC, need Letter from Embassy which has asked for Police Clearance Certificate (where from I can get this letter??)
I heard from my friends, its very hard to get PCC form local and District police office in India for NRI�s (anybody experienced similar situation, please just guide us/ is it take time?? )
One more doubt , is it possible get police clearance without Package-3 (? Any special form for PCC in Package-3)
