Hi!
When i was in India, my company applied for H1B visa. In the meantime I got married and came to US on H4 visa. After a month, my H1B was approved. Now, my company is planning to apply for a change of status. I have the following queries:
1. Do we have to fill in I 539 form or I 129 form
2. How long is the processing time?
3. Will i be eligible to work from Oct 1st, 2007 even though the change of status case is in process? Or should i wait till its been approved?
please help me. Your responses will be greatly appreciated.

> Traveling to US on June-15, 2011
> Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011
1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?
Appreciate any inputs on this.

I have applied for AOS/EAD/AP. I am moving to a new address soon. Will the recipt and EAD/AP be sent to me Old address? I am worried that they may get lost.

Hi,

When going through the RFE response, our attorney identified another mistake in the petition and believed the best action was to withdraw it and file a new H1 extension petition. The RFE 'respond by' date has also passed now. Since my previous H1 has expired, would this new H1 Extension petition be considered a valid one? I have my EAD and can continue to work on that till this H1 is approved. Please offer any suggestions you may have and let me know if there is anything else I can do.

Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.

Another more circuitous method if you want to make the entire object transparent is to import the movie into a movie clip inside Flash. You can use Flash's Alpha slider to adjust the alpha of the movie clip and adjust the quality that way.

the LCA needs to be done for any H1B or when the job is in a new location. it doesn't take long to get that submitted (<1 day) no need to go stamping. it doesn't cost any money to submit a new LCA

My recent EAD renewal had issues with the validity dates so I sent both the EAD (mine and my spouse) for correction. I received my EAD back with dates corrected but not for my wife. I called USCIS and one nice rep sent an email to the EAD supervisor requesting action but this was only a week ago. My wife now has a job offer but she is unsure if she could proceed due to lack of a EAD. This is obviously very frustrating for her since it was so hard to find a entry level job in this economy
I got a infopass but only for next week and it will be a little too late for the new job. She has to report to work next week. Any suggestions/thoughts for a way out will be helpful. FYI 90 days have passed since my initial EAD renewal application. I am considering opening a SR but that has a time line of 60-90 days

I have a question, actually I worked with a for-profit company A for few years and then transferred my H1B to a not-for-profit company B last year. Now can I transfer my H1B to a for-profit company C?
Actually one of my friend told, it is not possible and I can transfer only to the not-for-profit companies as I am currently working with a not-for-profit company B. Is this true?

I had applied on July 19th to Nebraska. My I-140 was approved from TX.
Today I received transfer notice WAC...., mentioning that they have transferred my case to TX Service center.
The receipt date is of Sep 14th, Notice date of Sep 17th'2007.
Does it mean I lost the original filing receipt date of July 20th'2007.

I am on US since Apr 2003 on L1B and it expires on Jan 25 2008
Last week my employer applied for L1A and it got approved. Approval notice says the new L1A visa is valid from Jan 26 2008 to Jan 26 2010(2 years)
I am planning to travel to india on vacation at dec 2007 and come back to US on Jan 1 2008
1) If I travel back to US on Jan 1 2008 without stamping L1A on passport, will the port of entry officer give I94 till Jan 26 2010 if I show the approved L1A I797 petition?
2) If I stamp L1A from India, when stamping the new L1A, I assume they will cancel my current L1B and stamp L1A which is valid only from Jan 26 2008. Am I correct? Then I will not be able to travel on Jan 1st 2008 since I dont have a valid visa stamped on passport at that time!
What to do ....Please help!

Normally, entering into the US follows the last entry rule. Thus, whatever status a person last enters on is their status.
There are special regulations when it comes to H-1b status and travelling on AP. I would speak with an attorney prior to travelling.

If you have only one copy ICE officer will make a copy at the port of entry and give you the original. If you have two copies, ICE will take one and give you the other.
