    Visitor's visa for my parents expired recently (it was a 5 yr VISA & they visited here 3 times and returned within 6 months each time) and they want to re-apply for a visa. My question is - Do I still need to send in the Document of Support, Employer and Bank letter or they can re-apply without these documents? On the safer side, I am sending the documents but in my view there should not be a need for the support documents...Anyone in similar boat?

    A hypothetical question: if I discontinue my current employment, how soon will I need to get a new job/offer in order to continue the I-485 adjustment status? Currently I-485 is pending for more than 180 days.

    WASHINGTON (AP) -- When President Bush invited lawmakers for a picnic, an approaching storm threatened to derail the event. His spokesman, Tony Snow, suggested that Democratic leaders in Congress secretly wanted it that way.

    "They've been seeding the clouds," he said.

    A little joke, a little suspicion. It seemed appropriate for Bush's relationship with House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid.

    In public, there are promises to work together, then unmistakable acrimony. Private dealings are respectful, but not fully trustful.

    Where ill will seeps out between Bush and the two Democratic leaders, it is not based on personal animus, those close to them say. Rather, it is rooted in vastly different views of how to run the country, and how much say each side has in running it.

    Pelosi and Reid say Bush blithely dismisses their roles as leaders of a coequal branch of government; Bush says they overreach and meddle, never more so than in the case of the war in Iraq.

    How well they get along, a fascination in Washington, is important in a much broader sense: It affects what they get done for the country.

    On that front, progress has been slow during the first half-year of this divided government.

    Bush and Democratic leaders agreed on new trade-policy guidelines, but Congress later refused to renew his fast-track trade power. Bush vetoed the Democrats' bid to expand stem cell research, a move that Reid and Pelosi called deplorable.

    The president's immigration overhaul is dead. A potential energy agreement looks shaky at best. Bush is also in a worsening standoff with Congress over the firing of U.S. attorneys, and a huge fight is brewing over the main spending bills that keep the government in operation.

    And, of course, there's the war.

    "It's hard to know how they would get along without Iraq," said Charles Jones, who studies relations between Congress and the president as a nonresident senior fellow for The Brookings Institution.

    "There are some issues on which they would probably work pretty effectively together, but the overlay of Iraq and the intense conflicts spills over," Jones said. "It makes it difficult for them just to say, 'Well, let's forget Iraq and work nicely on other issues.'"

    The White House disputes that spillover, citing quiet negotiations taking place to renew Bush's education law and work with Democrats on the immigration legislation. The immigration bill died when conservatives in Bush's own party rebelled against it.

    Iraq may be the better test case of Bush's relationship with Reid and Pelosi.

    It took more than three months for Bush and Congress to agree on a war funding bill, gobbling up valuable and finite legislative time.

    Bush vetoed the Democrats' first try because it included a timeline for U.S. troop withdrawal. Then came a grim meeting in which Bush, Pelosi and Reid chose negotiators but got little else done.

    In the days that followed, Pelosi miffed the White House by holding a vote to pay for the war in stages, drawing another veto threat. Another negotiation session broke down.

    Ultimately, hemmed in by time, both sides had to give or risk the political catastrophe of leaving combat troops unfunded.

    So Democrats gave up the timeline for withdrawal. Bush agreed to add domestic spending to the bill and establish benchmarks for measuring progress in Iraq.

    "The vote showed what's possible when we work together," the president said.

    The reality is that the compromise was forced upon them all, because no one wanted to cut off money for the troops.

    Still, quietly, some trust built through the experience. Bush's chief of staff, Josh Bolten, appreciated that Reid kept his word during negotiations; Reid respected that no details leaked from those private talks. He now says that Bush is listening more, but only compared with zero cooperation in prior years.

    Bush's tendency has never been to engage Congress, said James Thurber, director of the Center for Congressional and Presidential Studies at American University.

    "He doesn't have a close relationship with either one of them," Thurber said, referring to Pelosi and Reid. "I think that makes a difference. I don't see any evidence that he has come around to engaging the opposition party the way (Bill) Clinton did."

    Bush, Reid and Pelosi all dismiss the idea that they don't like one another despite the constant public harping.

    When the cameras are off, the tone is different, said Senate Minority Leader Mitch McConnell, R-Ky, who has sat with Reid and Pelosi in private sessions with Bush.

    "It's not an acrimonious kind of thing," McConnell said. "In all the meetings I've been in, there's never been a lack of courtesy. I don't think there's anything personal. We are just in different places. Everybody fully understands that we have different agendas."

    Yes, I did get a business checkin card. Credit card, I guess, I can get only when the EIN number develops some history. Do you already have a business checking card?

    I am on 8th H1b extension with approved I140 and 3yr extension. Now I want to join a new company, who does my H1B and will get 3yr extension on that. If my parent employer revokes my I140, will my new H1B (with new employer) gets void ? or is it still valid for me to work with new employer for next 3 years. I dont want to apply for LC and I140 with the new employer as I will be R2I in August 2007.

    I have my I 140 and I 485 (Aug 07 filer) for a future employment from a small company with EB2 as software engineer. I 140 still pending and got an RFE. I got the EAD. In a month am going to finish 180 days.


    Currently, I work for Fortune's Best software company as sr. software QA engineer. My company wants to go ahead filing for my GC.

    As this current company being a best american software company and I can stay for any longer, I wish to go ahead with filing for a fresh GC. However, I was wondering how I could use the benefits of the priority date from the previous 485 filing mentioned above. my company attorney suggests that am eligible for EB3 where as my 485 already filed is under EB2.

    What would be the implication if my current employers files for EB3 and my previous I 485 filing is under EB2. What are the options that are available for leveraging the benefits of my previous filing or using EAD?

    What is the best course of action.

    Hi,

    I got RFE on Advance Parole requesting proof that I have complied with NSEERS.

    All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.

    Last time I travelled out of US was back in May 2001 for couple of weeks.

    Now got this RFE any idea what do I need to submit.

    Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. is there any problem is getting profits more then 500K in a year.

    The post office cannot forward your card. If there is a name
    other than yours on the mailbox you use to get your mail,
    the post office will not deliver your card. In either of these situations,
    they will return your card to us as undeliverable.
    - If you move before you get your card, notify your post
    office, but also call our customer service number to update
    your address and emphasize when calling that you are waiting
    for your card.
    - If you are living with someone else, and that person’s
    name is on the mailbox, we recommend you add your name
    to the mailbox, or you run the risk the post office will return
    your card to us as undeliverable

    Something I found on USCIS site. Not sure if it applied to just the greencard or the EAD card as well. But this is a good tip.

    I came to US on J1 visa (exchange visitor program) and got waiver and converted to H1 visa. I could not apply for I-140 due to employers problems and now I have short of time for H1 extension.

    Can I convert my visa to J1 again? Is H1 to J1 visa possible? Please advise.

    Our I-485 applications were received by Texas Lock box on September 24th. I have not received the receipt number yet. We are leaving to India on Nov 20th for vacation, its quite stressful because we need that receipt before we travel.

    My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

    As Birth Certificate is part of Initial evidence, 2 secondary evidence affidavits for incomplete/incorrect entries is always good for peace of mind. Search for numerous threads on Birth Certificates last month for affidavit format, who can provide etc.

    Hello Gurus ,
    I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .

    Will I qualify for 3 year H1 extension based on my approved I-140 .?
