    Hi, I have been noticing on .com that even after the mess-ups in Aug 08 when similar visa bulletin came out and uscis approved lots of cases from 06 ignoring people from 04 and 05, they are not approving cases in pd order even now (well not like before but still bad). I mean how can they approve sep 05 cases before all 03/2005 cases are approved especially if they are all pre-adj and ready (atleast most are). Even though technically anyone until oct 1, 2005 is eligible for visa number, Shouldn't they go in order? This is very unfair given you don't know when they might run out of numbers and TSC is snail paced doing 3-6 approvals a day atmost while NSC is doing tons a day :) Any comments?

    Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill. In the mean time, advocacy groups are apparently still arguing about the final language including answering whether college...

    There are instructions on your original letter from the IRS telling you that your application for an ITIN number was granted. I believe you need a copy of that letter and a copy of your ssn to send back to them. If you cant find instructions send me a private message and I will pull my letter out for you.

    This evening, I watched a debate on television between a proponent and an opponent of comprehensive immigration reform (CIR). The proponent emphasized that we need CIR not for the benefit of the undocumented but because it would stimulate the American economy. The opponent said that this amounted to "open borders" and that our immigration system was already generous enough in the eyes of most Americans.     I received a RFE on 485 for a updated G-325 form and a Employment letter stating the Job details, Salary and if the Immigrant visa petition(labor certification) terms still exist. Iam a Jul,2007 filer, I have another 12 days to respond, this RFE was received by the company attorney. Now neither Employer/Company Attorney are responding to Phone calls/Emails regarding responding this to RFE. I do not understand what is their concern but came to know that few others from the same company got RFE on 485. Time is running out and if there is no response to the RFE, eventually the case will be denied. What are my options, Iam in my 4th year of my H1. I have a Valid EAD till Nov'2010 and H1 valid till Aug'2011. What will be my status if the 485 gets denied. Can I transfer the H1 to another employer and will need to start the GC process all over again ?
    Any advice suggestions appreciated.

    My local congressman got this reply from USCIS on my AP renewal case. Its been over 90 days and pending? Please help with any advice.

    The processing of this case has been delayed. A check of our records establishes that this case is not yet ready for decision, as the required investigation into the applicant background remains open.

    Until the background investigation is completed, we cannot move forward on this case. These background checks are required to be completed on all applicants who apply for the immigration benefit they are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete.

    I find that just importing my Swift3D output into Flash and then exporting it again I can reduce file size from 50 kb to 5kb. and usually this is good enough.

    My husband I-140 receipt notice has a wrong receipt date, instead of june 20 it has july 20 receipt date, the rest of the forms like I-485,Ap has the right receipt date, since he filed for labor substitution receipt date is critical since the deadline was july 16, what should we do anyone has the same situation pls help:confused:

    Hi,

    I would like to know can i change employer after my i-140 got approved.My i-140 got approved 6 months back and i have h1 until next year

    You can shift to new employer and start the GC process again. The approved I-140 is useful to retain the PD if not revoked. Otherwise no use.

    I know ability to pay issue is analyzed at I-140 stage, but the ability to pay the proffered wage begins at priority date and ends at the time I-485 is approved.

    After I-140 approval, could be ability to pay examined again?

    I read that someone went to an interview and was asked for sponsor company's taxes in order to check if the company still had ability to pay the salary.

    Would be possible an RFE asking for updated financials of the company?

    Gurus,

    To all those who have received the FP notices,are your I-485 dates current for Processing ? or you have received these notices after the lapsing of the earlier FP ??

    I have done one FP initially when my Case was filed.Its been long since the validity of that FP has lapsed. Should i be expecting another FP notice??
    Is fresh FP notice being sent to all those whose FP validity has expired? or are they doing that in a random manner ??

    IN LARGE PART, modern U.S. nuclear nonproliferation policy began with India. India received U.S. aid under the "Atoms for Peace" program of the early Cold War era -- only to lose its U.S. fuel supply because India, which had refused to sign the 1968 nuclear Non-Proliferation Treaty (NPT), exploded a nuclear "device" in 1974. Decades of U.S. noncooperation with India's civilian atomic energy program were intended to teach India, and the world, a lesson: You will not prosper if you go nuclear outside the system of international safeguards.

    Friday marked another step toward the end of that policy -- also with India. The Bush administration and New Delhi announced the principles by which the United States will resume sales of civilian nuclear fuel and technology to India, as promised by President Bush in July 2005. The fine print of the agreement, which must still be approved by the 45-nation Nuclear Suppliers Group and by Congress, has not yet been released. But the big picture is clear: The administration is betting that the benefits to the United States and the world of a "strategic partnership" with India outweigh the risks of a giant exception to the old rules of the nonproliferation game.

    There are good reasons to make the bet. India is a booming democracy of more than 1 billion people, clearly destined to play a growing role on the world stage. It can help the United States as a trading partner and as a strategic counterweight to China and Islamic extremists. If India uses more nuclear energy, it will emit less greenhouse gas. Perhaps most important, India has developed its own nuclear arsenal without selling materials or know-how to other potentially dangerous states. This is more than can be said for Pakistan, home of the notorious A.Q. Khan nuclear network.

    You can call this a double standard, as some of the agreement's critics do: one set of rules for countries we like, another for those we don't. Or you can call it realism: The agreement provides for more international supervision of India's nuclear fuel cycle than there would be without it. For example, it allows India to reprocess atomic fuel but at a new facility under International Atomic Energy Agency supervision, to protect against its diversion into weapons. The case for admitting India to the nuclear club is based on the plausible notion that the political character of a nuclear-armed state can be as important, or more important, than its signature on the NPT. North Korea, a Stalinist dictatorship, went nuclear while a member of the NPT; the Islamic Republic of Iran appears headed down the same road. Yet India's democratic system and its manifest interest in joining the global free-market economy suggest that it will behave responsibly.

    Or so it must be hoped. The few details of the agreement released Friday suggest that it is very favorable to India indeed, while skating close to the edge of U.S. law. For example, the United States committed to helping India accumulate a nuclear fuel stockpile, thus insulating New Delhi against the threat, provided for by U.S. law, of a supply cutoff in the unlikely event that India resumes weapons testing. Congress is also asking appropriate questions about India's military-to-military contacts with Iran and about New Delhi's stubborn habit of attending meetings of "non-aligned" countries at which Cuba, Venezuela and others bash the United States. As Congress considers this deal, India might well focus on what it can do to show that it, too, thinks of the new strategic partnership with Washington as a two-way street.

    I am one of the ones who had missed the July 07 boat. My PD is finally current.
    My attorney is getting ready to file all the items (485, EAD, AP etc) tomorrow.

    How soon can I expect the FP Notice?
    Also, since I am applying only now, how long before I can hope to see Green?

    There has been an error in the processing of my I-130 petition for my mother. It was approved and now I am being asked to submit form I-485 or form I-824. The problem is that my mother is not and has never been to the US. I called CIS and talked to a representative about the error. She said she would send a letter to the CIS about it and that I should hear back from CIS in 5 days. I am just wondering if this timeline is realistic or I should expect it to take more time. Should I contact my senator and ask for assistance in facilitating this process? Would hiring a lawyer expedite this process? I know that the petition should then go to the NVC. Would a lawyer help?

    Hi,

    I was on H1 VISA when my wife came here on H4 VISA. When I was filled her DS-157 form for H4 Stamping by mistake I put the wrong dates of employment.

    Now she got her H1 Visa approved when she was here in US. She is going for H1 Visa stamping . She is filling her DS-157 again with the correct dates. Would it be a problem. Would H4 DS-157 be tied back to DS-157 for H1 while she is there for H1 Stamping.

    Please any help would be appreciated.
