Friends,
At the time of granting Green Card, USCIS may RFE request for evidence. What exactly do they need me to provde, in particular when AC21 is involved?
Just employment letters? Or do they need pay stubs from the NEW employer as well? Then only the most recent paycheck or the whole history of payroll information with the NEW employer?
Appreciate your help.
In my case, I-140 was approved, and I-485 submitted over 180 days. Then I plan to invoke AC21 working for a new employer with similar job.

Ask your brother to get a leave letter from his company. It should help.

It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...
That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future

Approximately 34,900 cases have been receipted by USCIS for the regular Bachelor's degree H-1B quota.
Approximately 13,000 cases have been receipted by USCIS for the advanced degree H-1B quota open to applicants who have earned Master's or higher degrees from US colleges and universities.

If my priority date is current based on March visa bulletin, till what date can I file for my 485? Do I have time until end of April?
You can file anytime after your dates are current.. Just don't take too long though, Remember if the dates retrogress again, then might get out of luck! Again!! So file it right away if you can...

If one has EB1 (Extraordinary Ability) Pending, is one allowed to stay in the US until the case is decided? I know it may takes at least an year for the final approval...

Hi,
My Priority date is Jun 2006/EB2 India. After the Aug bulletin I'm now afraid that my priority date might get current next month.
My concern is that I might be getting married in the near future and I don't want to deal with an immigration nightmare for my spouse. At the same time I don't want to rush a decision like getting married based on USCIS priority dates. Is there anyway I could delay my GC adjudication for 3-4 months to get some more time ...

I got really good news... EB3 moved for 1 week...... its 22nd Jan 2002 now...:rolleyes:
Based on the numbers released by USCIS on pending 485s, EB3 will go up to mid-june 2002 for the entire FY2011 (without spill over, of course)....

If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

you can claim him if:
1) He didn't earn more than $3500 in 2010
2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)
If you paid for his tuition, you may be able to claim tuition credits for him too.

The big news is that the masters cap was hit as of December 24th. I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent. The general quota has 7,700 visas of 65,000 remaining as of December 31st and the rolling four week average is now running at just over 1500. I am working on EAD for a company A (I have approved H1 with company B). i want to maintain both the statuses, can i do that by running the paycheck with H1 company?
You cannot be on H1-B if you are working using EAD.
2)
my fiancee is on H1 status and i want to change her status from H1 to H4 (H1 getting expired). will it be ok as long as i maiting H1 status?

In order to qualify for H-4, the person has to be a legal dependent on the person holding H1-B. AFAIK, fiancee is not legally a dependent.

We got something similar. I have seen other posts in the forums but can't find them now. I would suggest you go for the fingerprints/biometrics and be done with it. Don't give them an excuse to actually implement "if you don't show up, your application will be considered abandoned".

I am on 8th H1b extension with approved I140 and 3yr extension. Now I want to join a new company, who does my H1B and will get 3yr extension on that. If my parent employer revokes my I140, will my new H1B (with new employer) gets void ? or is it still valid for me to work with new employer for next 3 years. I dont want to apply for LC and I140 with the new employer as I will be R2I in August 2007.
