Immigrating legally to the U.S seemed like a gold opportunity when I was offered to work here six years ago with an H1B visa. As a matter of fact, all my friends and family considered that it would have been crazy not to take advantage of the "opportunity" to live and work in the most developed country on Earth.
It's been six long years of challenges and learning experiences, but mostly it's been six years of financial distress, anxiety, paralysis and uncertainty.
We applied for PR four years ago, but in the process my wife and I have eaten all our saving in lawyer fees - and at this point we're just one more number in the long list of EB3 applicants who don't have the remotest idea of when visa numbers will become available so we can have a normal life. I don't even consider traveling to my country cause I don't have the money to pay for APs for me and my wife. My career has been also frozen since I cant take promotions to higher positions that will fall off the job description stated in my PERM.
If I had known about this ordeal, I would have never come to the US. I would have looked for other options, in countries that have a more sincere and generous immigration policies instead. If the US is not interested in allowing people to legally immigrate through visas based on employment, they simply should eliminate these visas and make clear that they don't want us to stay. Wouldn't that be easy for everyone?
I would return to my country if we didn't have a nasty political turmoil and the social decay that comes with it. Yet, I feel that the days go by and our lives are entangled in this absurd situation.
Just to clarify your logic of thoughts: when you came here you came here on H-1 (non-immigrat visa) to work and make money. At a time you were never immigrant, you were TEMORARY WORKER. on coming here, probably after experiencing few years life here and comparing that to your home country, you felt it better and DECIDED To IMMIGRATE and APPLIED FOR GC. Unfortunately that process is legal mess so you dont like that mess. But if you do little soul search if you didnt like here you should not have applied for your GC, Just have made money (as your initial objective) and went back home with strong experience and lot of cash. I have seen couple of people doing that. They come here, they feel that this country is not for them, they still stay on H1 make money survive on very less money and then go home. Once they go home they even dont need to work if they wish so. But you did not made that choice but decided to stay here, not because of GC, GC was just medium to stay here.

This was directed to people who were current. If you are from India, China, Mexico, Philippines, get used to waiting. Your backlog is due to numerical limits. And this won't change (the way I see it)

It is so confusing that I do not know how to explain the whole thing.
Here is a small sample.
In 2002 all the EB visas were issued(174,968). However, there were 31,532 unused family preference visas, so the limit for 2003 was 171,532 (140,000 + 31,532).
Guess what, in 2003 they only approved 82,137 EB visas, so they ended up with 88,482 unused EB visas

This also tells me that an increase in visa numbers to 290,000 (or what ever number that the SKILL bill is asking for) would NOT change the situation a little bit. The end result only will be that the USCIS will end up with more number of unused visas.
Can the IV community do some thing to improve the whole situation?
I am seeing two specific bottlenecks.
1. Delay in USCIS to process applications. This is an area, that we can do something. And I am already seeing a huge improvement from USCIS in terms of fast processing.
2. Delay in FBI namecheck. Again this is an area we can do something. I don't know what, but there should be something that we can do. Many of my friends have been writing to Laura Bush explaining their FBI namecheck bottleneck and a few of them got positive results.

Bad news unless they allow mass conversion of TR applications into non-RIR. Imagine they took two years to get rid of 220,000 easier applications (2005 and 2006). Now they are left with some of the old TR applications and they must be thinking of how to meet the September deadline. I would not be surprised if they ask for an extension, citing processing difficulties.

One thing I fail to understand, instead of flower compaign why do not we go in for letter compaign. Write letter to DOS and USCIS with copies to members of the congress highlighting all their inefficiencies and inconsistencies. USCIS does not deserve flowers for what it has done to us and what it is doing to us. Do you get flowers and info pass appointment ? Does customer service speak nicely to you and give you right answers ? Do you give flowers to anybody who mistreats you in real life ? I know Munbai ...has impressed a lot but that was a movie. Have you ever realized what would have happened, had it not been a movie ? Things would not have moved at all.

He's been an advocate on backlog issues, and his staff had helped look into my case last year. I used his web site to send him an email (for VA residents only), slightly modifying the phone script to thank him, since I finally got my green card in November. Will post response when I receive it.

My AP was filed on July 2nd along with 485 but receipt shows Oct 1st, any how received AP approved notice on Oct 23rd to my communication address but the USCIS online status was not updated till now with the Approval statement but I have the approved document, when I called the customer service they said it will take 30 to 60 day to get updated.
Any how there is a printing mistake of my Name I have send back my AP original again to USCIS to get it corrected, it was there mistake and almost 40 days now I have not got any response on my AP till now.
Please comment if any one with such situation.

If one can handle stress, anxiety and trauma while waiting for GC, then its worth waiting. If not, people like me start looking at options. I applied for Canadian PR in 2008 and just did CDN landing last week which gave my family feel of "cold weather".
I will be completing my 5 years stay in USA this spring. Same story here - I never visited my home country since there is a lot of uncertainty around getting back.
We are 100% sure that we don't want to continue living in USA. Now its matter of time, until summer 2010, that we move on. Just not sure yet - whether it is my home country or Canada. If I get a job back home in India, I would love to do that. From what I have heard from friends, and from recruiters response, in home country, I think economy is picking up. I hope to get some decent job offer based on my unique job profile; if it doesn't work, we will move on to Canada.

First of all congratulations to ind_game.
Today I received NOID for not submitting AC21. My I-140 is not revoked. I received an RFE last month for birth certificate & updated g-325a form. In the g-325a form I mentioned my current employer which would have triggered NOID for AC21.
I left the GC sponsored employer after 9 years on May 2008 well after 180 days and joined an insurance company. The company got hammered by financial crises. So I left that company and joined other stable company on Dec 2009 as a full time employee.
My current job description is similar to the one mentioned on ETA but not same. I am not sure if changing 2 jobs will be a problem.
If anyone had submitted any documents for AC21 please share. I will really appreciate it.

The people America would really be concerned about are outstanding researchers, but then these people fall in the EB1 category which is always current and so they have no cause for complaint. The other category that the US is concerned about is cheap and illegal labor, but that is not related to GCs. So in short, there is nothing about the Eb2/Eb3 GC backlog that America needs to worry about.
The delay causes anxiety & frustration only for us applicants. So the impact is only on us.

America does not need to do anything to get more workers. People will keep coming and it will always be a positive flow of good talent into America. The only Indians (and others) who might tell you that they do not want to come to the USA and the American dream is gone, etc., are talking bull and they know it. They will jump on a plane "the next minute" and come if the could. It's the same thing always: Go back Yankeee.................................and take me with you."

Vivek I do not fully agree with you. I do agree that first timers are eager to come to America but once the game gets exposed they will have second thoughts. Why there are no takers for german green card? Or why do people apply for HSMP in more numbers than any other european country. Because atleast on the face of it, that promises a long term path. How many people will want to jump on the plane if America says there will be no green cards, how many people will be attracted to it? America wants to have it both ways, they want people here but do not want to give GCs either.
I graduated from a good college in India. My classmates are divided 50-50 in US and India. The people who are putting up here either did very well and were toppers or failures. All others stayed in India and they will come here only if there is a long term benefit to come here.

EB must also get some additional visa numbers from FB as an 'interest' for these 'loaned' visas from EB to FB. Now we have to finalize the 'interest' rate. How about 100%? ;)

Looks like USCIS did all the easy work in June and now they are getting to grip with the reality (that they cannot process even 140K GC in a year!!!). How shameful. May be all the USCIS folks worked so hard during the last few weeks in June that they would have taken a long break from work after June:D:D

We know that the Service Centers have been working day and night and did not have enough resources to deal with the crisis which was brought about by the recent Visa Bulletin fiasco. We just hope for the better new fiscal year that will start from October 1, 2007.
