My wife was deported after being in the US for more than 9 years. She spent 4 months in jail. Your first question will be why didn't I get her papers for her, she didn't want to go through the hassles. We have been married for 4 years. She was arrested when we attempted to return from Mexico after a vacation she was on. They confiscated the vehicle and I was released without a record, gave me a break because I am retired military.
I have heard that there is a pardon process. Since the rest of her family is still in the US, we want to be able to return. I am in the process of moving to Mexico to be with my wife.
Can anyone shed some light on a "Pardon"?

Hi,
My wife and I both have EAD and AP. My wife is derivative on my 485 application. I am using H1b for employment though, while my wife is using EAD for employment.
We are planning to travel to India. I am going to continue to use my H1 b as I am going for visa stamping on my trip to India. My wife will be using AP for reentry.
Questions:
1) Do you see any complications while reentering in this scenario either for me or for my wife since I will be using H1 visa and she will be using AP.
2) Does she need to carry her employment verification letter since she is derivative of my application? Can the IO at poe entry ask for her employment? What should she be saying her purpose of visit or any such questions? Would it be ok to mention 'pending AOS' as the status.

I am on H4 visa, based in Georgia. Did anyone get �Change of Maiden Name to Married Name� done on passport from Indian Consulate Houston, TX.
Can anyone tell me what am I supposed to write in the �Surname� column in the new online application form ? The old application had 2 columns, 1 for maiden name and the other for Desired Name, but the new online application form has only 1 Surname column. I am confused as to what should I write � my maiden name or my married name. I do have the notarization done on the affidavit form. Does this give me the right to write my married name ? My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.

My 6years of H1 expires on Apr'2011. Company A filed for perm, perm went to Audit, Got 7th year extension which expires Apr'2012
Later, moved to Company B, got Change of Employer approved until Apr'2012.
Now I am going to India and need to get stamping. Will I have any issues in getting the visa stamping for 7th year? Please advice.
Both Company A and B are very big companies and I am direct employee not a contractor.
I have the CompanyA's perm screenshot and email, but don't know what its status, as i left the company and I am not in touch with them

Can a person join a new employer for doing his LC, based on already sent out ads ???
what they are telling me is that the ad is very general for EB2 which was sent out even before one joined the company. so my question would be that can a person go ahead and use the already sent out ads or one should raise some red falgs, not to go for it ???
