Hi Friends,
My H1b 6 years time will expire on March 24th, 2011. One of my previous employer (eData experts) based out of PA had filed for my PERM labor in 12/12/1007.
But unfortunately due to their negligence it was denied and I was only told about only after 3 months. I currently work for another employer and they have not started my GC processing yet. I don't want to work for this new company because of lot of work pressure which is affecting my work life balance. Can someone out there please suggest me the options to stay in this country. This is very urgent. Your suggestions are really valuable for me. Appreciate your time.

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.
The only reason iam planning to file h1b in 2-3 months from now is i dont have last 2months of paystubs as i was on vacation and other reason is my current project may be done in may or june.
So please advise me what is the best way to deal with the situation.

I was on H1 with my previous company but laid off last week. I have !485 AOS and EAD.
I believe I can straight away join any company (consultancy or any enterprise company) on EAD , right pls ?
if get a job offer from Comapny "A" and join them today and file AC-21 today and meanwhile say I get another job from another Company "B" after two days and join them, can I file another AC-21 without waiting to hear back from USCIS. I believe AC 21 is just informational for USCIS that I have switched the jobs.

Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. My wife has a valid H4 visa and she's currently in India as her company is applying for a fresh H1B visa for her. I'm currently in US on valid H1B visa till 7-Dec-2011.(Her H4 will also expire on the same date)
Qs: After getting the recipt for H1B application, can she travel on her H4 visa or does she have to wait till the approval\rejection of H1B?
Please note that this is not a case of H4 to H1 transfer.

You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger
where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal
I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional
Now my question is what is the procedure to rectify this ? Also will I hold on to the processing dates {NOT Priority date} (say May 25th) for I-140 or should the lawyer file new appliaction which will push my I-140 petition dates to June?

Is any one got receipt of 485filing on july 2nd? Please post the status like checks are cashed, receipt,retuns etc.
