Hi,
I am an architect, on OPT right now but do not have a job.I am looking for one, and hope to get one by April. I am looking for H1 sponsorships, and as is well known, the visa has to be applied by April 1.
However it is difficult to find a job by then AND get my employer to sponsor me by April 1.
Does anyone know how long will the window to file H1s be open this year?
I am guessing that this year, the number of H1s filed willbe lesser than the 65000 limit....do you think that the window will be open longer?(I want to buy more time to apply)
Please let me know.

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

It doesn't look like a sunset initially. At first I thought it was a picture of fire with the outline of a dragon in the bottom left in orange haha. The text could be a bit more legible though. The malaysia text looks a bit blurred in areas.

I did it through an attorney and captured about 5 months.
They did a photo copy of my entry/exit dates in the Passport and copy of all my previous I94 cards. Along with that they sent in a Letter asking USCIS for the recapture.
It was a H1 transfer and recapture at the same time. I got approved for 17 months ( 1 Year + 5months recapture). at that time, I was over 6 years without I140 approved.

Spouse I-485 Receipt Notice.
Applied I-485 for my wife in the first week of September (8th Sept) when the dates became current, but haven't received the receipt
number yet.
I got an RFE (EVL) on my application which I submitted on 21 Sept. USCIS received the response on 22nd Sept and updated the case.
I am little worried that whether USCIS has received her application or not. Is there a way to find out, whether I can open an Service request or take an Info Pass regarding this?
Any suggestions will be helpful.

i remember there are about 40,000 file to TSC on July 2nd, while 35,000 file to NSC. Why no one say something?

one of my friend worked here on L1 for couple of years for employer A.
then he got a H1 approved effective from Oct'07, with employer B.
but, he did not actually start working under employer B on H1 (payroll) until Mar'08.
he continued working under employer A on L1 ( has paystubs without any break) until Mar'08 and then worked with employer B on H1.
now he did a cap-exmpt H1 transfer to employer C, got H1 apporved and they are filing for GC labor PERM petition.
question is, while providing his previous employers info in the PERM petition,
can he say that he worked with employer A on L1 until Mar'08, even though his H1 with employer B is effective from oct'07?
appreciate any advice

I was trying to find out if one can transfer from b1/b2 visa category to H1- B visa within the valid period of stay(i.e before the expiry of the I-94).

No issues, since her H1B is independent of your I-485. As long as she was in her old job/the job mentioned on her G-325 on the day you filed your app. you should be okay.

I am in EB3 with Labor and I-140 approved, I-485 in process, and have EAD/AP. If I switch employers and take up a new role (different from the one GC application is based on), and not file AC21 (because that's not applicable when switching job roles), should I continue to stay mum hoping to not receive a RFE for EVL and get a GC by mail silently someday or request new employer to file a new EB2 perm and preserve the old (2002) priority date?
In case I go with the former, and end up receiving a RFE, can I explain my true status and go for the latter at that point? What are the chances that one will receive an RFE for Employment verification for a case that has been pending for 7 years, and I-485 pending for 3 years?
Any personal experiences and guidance will greatly help me. Thank you!

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.
Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. The DOL, in fact, stated that LCAs are being processed within four to five days which is in fact true as well. It is our suggestion to plan accordingly.

Hi Folks,
I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..
Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

Hello Friends,
I have a question regarding waiver on J2 EAD.
My husband is doing residency on J1 since last 9 months. His residency program is of 4years and plans to do 1 yr fellowship later on on J1 so total of 5 yrs
I m now on J2 and have an EAD with me.
My questions are:
1. Do I need to do a waiver job after I complete my residency on EAD before joining any other hospital here in the US? or it just applies to my husband(on J1) to do a waiver.
2. If aftercompleting my residency on EAD, if my husband gets a waiver he will be on H1 and me on H4and if the same year I get H1 fellowship program for 1 yr, can I change my status from J2 EAD to H1 without doing a waiver?
3. How much time it normally takes to renew your EAD?

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

I have an Indian passport and currently working in USA on L1B visa. Before leaving India I initiated the process of getting permanent residence visa from Australia and while I was in USA I got the AU Independent (Migrant) Visa (Subclass 175) visa approved and it was stamped on my passport by the AU embassy in Washington DC.
My queries are:
- I am planning to go for a vacation to India very soon. While returning to USA will it be a problem with my Indian passport having both USA L1B visa and AU migrant visa.
- For the initial entry to AU, I want to go there next year only for a week directly from USA. Will it be a issue for me to enter the US in my return trip
Your advice on this will be very helpful.
