I filed I-140 on July 5, and was hoping to get the receipt by this week because as per the press release ( dated 7/13), NSC was supposed to be time complaint with regards to I-140 receipt date by 7/18/2007. But they again changed to 8/1/2007. You never know they will NOT change it again!

May be we should try to lobby for a bill with one time relief of Backlog of EB retrogressed.
I feel that once this backlog is reduced, it will be easier for future applicants anyway as H1Bs are reduced to 65000 from last few years.
I request IV core to look into this option as the opposition from anti immigrants would be less for something like this. This has happened once before in yr 2000.

Experts,
I have done e-filing for my AP renewal. I read the instructions to see what documentation I need to mail,but I did not find any documentation specifically for e-filing. Does this mean that there is no need to send any documents? I heard USCIS will take picture during biometrics which is all they need. Can you please share your experiences on this. thanks a lot.

guys, we got fooled twice with this CIR, I just can't take these rollercoaster drive any more,

You should show some decency in replying to posts. Otherwise it reflects where you come from. - I come from a down to earth broad minded background where "we" together help and try to make lives better, .. but I am skeptical about you and your background because thats a selfish, mean and free loader character.

As so many members have posted there is no such thing as H1 transfer. If OP continued to work for employer# 2 without joining employer X that is fine as long as OP's employer 2 did not revoke the H1 petition. So OP should be fine , all he has to do is point that he did not accept employer X offer and decided to continue with current employer (i.e. #2) and his work with employer 2 was authorized based on the continued validity of h1 petition of employer 2. Now I saw that OP mentioned somewhere that he used EAD when his H1 with employer 2 expired. This could be a potential reason for the RFE. Here's my take on it:
When OP's H1 ultimately expired there were two possible work authorizations which OP could have used : Join the employer X on H1 since that employer did not revoke the h1 petition even though he did not join them OR used EAD with either employer 2 or employer X. The OP got this RFE for I-485. If you are doing AOS from H1 the burden is on you to prove that even while your I-485 is pending you have not engaged in unauthorized work. I just feel that the IO is doing an extensive scrutiny of the OP's application and trying to make sure that OP did not engage in unauthorized work at point.
In any case the OP should get a good lawyer.

My understanding is they wait until last quarter to give the spill over. But this time they started giving the numbers in 3rd quarter itself. Keep in mind EB1 is current and Eb2 except I and C is still current.
I expect to see at least 20k visa's issued to EB2 I and C.
EB2 China wont take much visas because EB2 china PD cut off date was already Jan 2006 a year back. So it takes its reguler 9,800 visas for this 2008 fiscal year.

My I-140 was filed on July 6 and arrives at USCIS on July 9.
The check was cashed on July 12 and I was able to get the receipt number. BUT BY NOW I HAVE NOT RECEIVE THE RECEIPT. It seems many people are in the same boat. What we can do about it?
Anybody knows how many days it would take between they cash the check and mail out the receipt? What address do they use?

I think it's still fine. The fact that this was brought up by the Secretary in the action directive says that this has got good traction up top. People aren't getting their green cards any sooner with this. I think this plays into a territory which is actually quite non-controversial even if it needs to be taken from a legislative perspective. Also they maybe thinking of something else too. Who knows. They've seen the data; they know that people from India/China EB2/EB3 and EB3 ROW are seeing a long wait in front of them right now.

Not really true. If you look at web site, they are now approving cases filed in June 07 even though the processing times bulletin says April 07.
All EB3 who filed their I140/I485 in June and afterwards have to wait till processing date cross at least June. Right now TSC is processing April 2007 cases.

They didnt even care to communicate that my wife's labor was approved, we called them to check and they said oh yes it was done 2 months ago :)
