I have been successfull to motivate a co-worker (EB3-ROW) to contribute to this cause.
Guys, remember not only India/China are suffering, EB3-ROW is also impacted . Forward this to anyone from EB3-ROW that you know

I think for first meeting 10-12 are enough. Let us meet and decide upon the strategy to have more people. I would prefer not to have lot of people in the first meeting.

I really hope sanity returns to the group and we make a concerted effort to get the current bills passed. As it is, we have an uphill battle, and now, if internally people start thinking that we are better off without the bills, we will never get anything done.
For people who are confused, unsure, unclear about the benefits of Specter/Frist's bill, the benefits are enormous
1. Right now, you have to wait 7-8 years in Eb3 category to get GC. Even if Specter/Frist's bill pass in the current form, and you are in Software, you could get yourself a MS in Comp. Science and get EAD in 1.5 years. Can you imagine the benefits of that?
Ask yourself the question - am I ok with my situation for the next 7-8 years?
The bill is not bad in its current form - we just want to make it better for us by including favorable clauses like 485 filiing and AC 21.
Do not always start looking at the darker side of things - we need something to happen to end the immigration imbroglio we are in. I cannot re-emphasize the need for a bill to pass this year that will contain EB provisions.

First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
I agree porting to EB2 will be much faster.

I recieved my I-140 receipt notice finally from Nebraska Service Center, it does not have the A#, may be due to the fact that I belong to EB3 category.
As one of my friend who is in EB2 category has an A# on his receipt notice which he got yesterday from Texas Service Center.

Lets NOT do a hunger strike.
Think of something that is unique, gets media attention, something that has not been done, but conveys the message in a very subtle way and yet is very powerful and will create a lump in the throat.
Free math turoring, free SAT preperation classes, you get the idea....
Good idea, do something constructive and get media attention. This solves multiple purposes, media attention, best use of time, and would also convey a positive message.

Yes, we need more help from the media. That is why we have the media event - press conference on Tuesday June 8th. We need members to be there to show a good representation of EB-Community. Apart from that we need to send these emails/letters to media and the reps in 1000's everyday, so that we get the attention we deserve. Thank you everybody that is participating and sending emails every day. We can also print out and send letters.

Great post. Couldn't agree with you more.
The more I read this form, the more I become disgruntled with this community! To say that someone from a lower class of visa and not from an "Oversubscribed country" (and I am assuming you mean India) is less skilled and less deserving than someone from a higher class and oversubscribed country is ludicrous to say the least. Each and everyone of us (and I mean "legal immigrants") have our own skill sets and contribute equally to the American society. As long as we are competent at what we do, then we are all SKILLED in our own way. The only real defining difference among the visa classes is the level of education not skill. To suggest one is better based on education alone is arrogance and nothing else!
The U.S. immigration system is not without its flaws and despite the delays and frustrations, it is FAIR! The per country limit is to ensure that citizens of ALL nations have an equal opportunity to immigrate to the U.S. and not just a select few. The only thing that I have found unfair as far as immigration in this country is concerned is the politicians focused efforts to do something for the "illegal" immigrants at the expense of the "legal" immigrants.
We are all in this together and the insults and innuendos that dominate this forum divide us so let's stop them and focus on the real issues!

USCIS does not work for you or me but sure you can go and ask them for prefiling AOS but not to issue RFE for same job requirement condition and other haressing rfe. how can you say we cannot ask USCIS not to raise RFE for irrelevant stuff,I guess you are ok with all the RFE that are being issued by USCIS on h1 holders currently. Sure some of those rfe are valid ones but vast majority of them are to kick h1 out. Does USCIS or any other department issue rfe to GC holders when there is something "fishy" as you put it. Like I said as long as you work in the relevant field in which your labor got certified we can ask to be left alone. Its one thing to get an rfe for birth certificate, medical records and another thing if you are issued the sort of rfe that are being issued to h1. You and all the people who missed out on July fiasco obviously want to file AOS and get EAD at any cost (i understand and support that ) but what about us who have been here for 5 to 10 years and took us multiple years of wait to file AOS and get EAD. Without strengthening AC21\EAD and allowing everyone to file AOS is going to attract USCIS, grasley, sanders and all anti eb folks attention.
You have a great plan, come to US on H1 and within 6 months get EAD and you are free from H1b crackdown by jumping to EAD. You think USCIS, Grasley, sanders, and anti eb folks are a bunch of idiots, they will send you and me packing with the same rfe they are hitting h1 folks with if everybody gets to pre file AOS and get EAD. that is why you need to strengthen ac21 by removing same\semilar job condition and other potential h1 like rfe's, otherwise you will drag us down along with you and turn ead into h1.
Anyway I have made my point in this post and all my previous posts. ASK anybody who has been waiting for last 5 to 10 years without GC If what I said is wrong or laughable. I am not one of those bitter folks who says its my way or the highway. Good luck to you guys.
Dude,
Be pragmatic. How can you ask CIS NOT to raise RFE's for EAD extensions? If they find some thing fishy they would definitely dig the issue. Remember, CIS is not working for you or for me. I cannot stop laughing!
Even now I do not understand how prefiling of AOS is related to Remove\dilute same similar job requirement? If you feel there is so much of importance for your SO COMPLEX CUSTOMIZED REQUIREMENT then why dont you start a new action item and gather people? Believe me I would be the first person to support you, because I understand the issue and I would like to work as a team. All I am saying is do not mix up the action items.
I hate to say this but your post is SO ridiculous which clearly implies that there is no place for people in IV who have PD's after may 2007.
I have a strong advice for you... 'THINK B4 U INK'

They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability.
I think pre-adjudication solves this catch-22 situation, and they have been pre-adjudicating quite a bit over the past two years. So, I dont think that this is an issue.

What the hell do u mean?
How many people in EB2 do a different job from EB3?
Most of the people in EB2 almost do the same programmer job. I have been in this country for a long time. I have friends who have done their MS from colleges like stanford, santa barbara. I don't see a difference in their role. I have more than 10 yrs of exp. I have worked in different roles too.
For jerks like u to come and talk abt people in EB3 being unskilled, makes me sick.
Shut the f*** up
And I think you need some reading lessons .... read my post ... the comparison is between categories for eg EB2 for IN/CHina vs EB3 for ROW
In any case the classification is not based on one's country of origin or individual's personal qualifications ... it is based on what the job requires. heck an individual having Phd can get a job which requires only 2 yrs study and no exp that doesnt mean that they are any less qualified that a person in EB1 for any country .... but the most value gained is in the EB1 category job....hence the argument.... nothing to do with where you are born or what individual qualifications you possess .... Im sure you are highly qualified and educated ... think and read ...

I have one question regarding your view. Actually point system gives points to the US experience and employer sponsorship. Because of limited number of greencards Those who are not having both of this may not be able to get green card. If you give your calculation everyone will get clear about. I think MS with 5 year US experience will get more points than fresh Phd. That serves the purpose. If that is the case then only eligible people will get gc.
Gautamagg (Gautam Aggrwal) is Columban.
Gautam: If you have difference with Immigration Voice's position in opposing the merits based system that gives 21 points being illegal and 20 points for having MBA or MD, then you are entitled to have that opinion, but dont peddle your agenda on this site and find another website or forum to advocate in favor of merits based points system.
Merits based point system awards supplemental points for illegals. Being illegal is not an accomplishment. Having an MBA or MD is. The two cannot be awarded merits on the same scale.
Merits based point system works well in countries that dont have annual caps. Like Canada. Their objective in Canada is to fill the country with younger working population in order to balance to demograph that is headed to an aging population. USA is not like that and having points system in conjunction with numerical caps will cause greencard to go to paper-tiger resumes that have lots of points but not employable. There are millions of Ph.Ds in Science in India and China and they would not be employable here but would get GCs. Just like Canada, we would have greencard holders with Ph.Ds and MBBS driving cabs. Employability has nothing to do with papers that prove how many years you spend on colleges accumalating degrees.
A bachelor's degree from Harvard and a Bachelor's degree from Rutgers would get same points : 16 points. Is that really a measure of merits?
But again, if you feel that point system is great, issue press release on your own and peddle your agenda on your own but dont use this site to peddle that agenda. You are free to discuss with other members but dont issue press release and dont speak to the media on behalf of IV. Speak to the media as an individual.
The position of immigration voice on points system is very clear and it will stay that way.

dont claim uei, it is for gc and citizens only.
That's not correct. Everybody pays UEI including the H1B people also. But if you are AOS status, the AOS demands you be in a job but it has nothing to do with UE benefits.
