"My wife's employer filed for her GC during 2007 August rush for all of us. Her case is in EB3 with Feb 2005 PD. My labor is approved and filed for I-140 about a year ago and still hasn't been approved. Now, my PD is current based on yesterday's Visa Bulletin. Can I file another I-485 for me with a pending I-485 thru my wife's employer?"

yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.
OR, you can wait, and once your 140 is approved and provided your PD is still current, you can transfer your wife's 485 to yours making you the primary and the wife the dependent.

Please and i'm begging you that please read the entire post and think for a moment before replying. I'm not in BEC, already filed my 485. I'm aware of the IV efforts towards getting relief for BEC people, I never disputed that. My point has been that the system and July bulletin is unfair (at least from one angle) and that calling it unfair/unjust should not upset others. I don't know what words were used by Bigtime and banning him was fair or unfair.
You want everyone else to suffer just because you suffered? or because older pd's suffered? life is not fair so get over with it... the sheer fact that you are in this country is a god's gift to you! So dont be judgmental about things...

Based on last week's BusinessWeek article, I have a feeling that we will see an effort to restrict initial H1B applications in some way. That would be a good opportunity to push for allowing naturalization applications for people who have been on work visas for a long time (say 8-10 yrs?). Fighting for citizenship would have a stronger emotional dimension and may connect better with the American public. A direct filing for citizenship will work around retrogression by providing an avenue for people to move out of the GC queue.

Logiclife's post may be a little strong in words. But it wasn't done with any ill-will toward anyone. Please remember it was borne out of frustrations borne out of some volunteers playing hokey at important IV events after RSVPing to attend and volunteer.
Naturally the organizer felt frustrated at the unexpectedly low-level participation at a very important event, for which significant personal sacrifice was done.
A word of advice to everyone - Do NOT volunteer to anything unless you are 100% sure you'll be doing it. Don't volunteer 'spur of the moment' to backtrack later. It's a rude and unprofessional conduct. We are all highly-skilled professionals here, right?
Take your time ( I mean weeks, a month or two, not 10-12 months of years !), become convinced about the IV cause. If you believe in it volunteer with full heart and conviction. And once you do, keep your words and promises. Don't make empty promises that aren't kept. It creates a very bad impression about you as a person. Not everyone will publish it here, but you'll be marked off as 'all talk, no action' from that point onwards.

Its time we start talking about "global though and emotion pollution".
Every house, group, town, city, state, country are all a collection of thoughts and emotions. If you could quantify these you could measure the amount of "waste" often with tremendously long half life periods that many of us are disposing into this pool. This is the greatest pollution from which infact all other pollutions even start to originate.
Our role during this life is to put some effort in trying to clean up this pool just like BP is now trying to clean up the oil mess.
How to start? stop being critical and avoid dissipating harmful thought about self and others:D:D:D

This does not extend to immigration benefit or opportunity lost due to lack of immigration benefit (such as I-485 approval).

A very surprising thing happened in our company today. Shocking it may seem, they laid off 5 employees in my department today without any notice. Today's happenings makes me want to gather as much info as possible in case something unexpected might happen.
I am a July 2nd filer of 140/485 concurrently. No I140 approval yet. Received AP and EAD for both me and my wife.
If I request my employer not to revoke I140, will I be able to use my EAD for my next job?
Can someone give suggestions on what other options I have if something terrible happens to me?

I don't think that Dems are quite there yet. I thought I saw CNN reporting one seat in Virginia still undecided. This is the seat where Allen's the incumbent. He is trailing by a thin margin, and I suppose there'd be a recount here. It appears Allen may lose his senate seat in Virginia thanks to his infamous utterance. In that case Dems have the majority.
If GOP were to retain majority in Senate and Dems in House, what would be fate of the congress? Will anything pass through both houses?

Last few lines of this artice is clear about Senate mood. Even IV wants to lobby sepeately for gc numbers IV has to come up with reasonable numbers based on requirement. Arbitary numbers or blanket exemptions will have more chance for failure.
But unless they can prove that they system is not currently being abused, and unless they can come up with specific figures for the number of visas required, they will have a hard time persuading lawmakers that the cap needs to be raised beyond the current proposal of 115,000.

True that the tech companies are not comming up with a cap because they believe by saying this, they might be restricted for many years to bring in extra people if they have an opening.
Before dot com bust even lot of US citizens welcomed H1b persons as there was not much layoffs. But past 7 years layoffs increased to outsource to India,China and other countries. For that they have to hire H1b and L1 persons from Countries mainly India. Those things made anti immigrants hardened their stand. US workers fear that they may lose job if US opens up immigration too much.
How did the anti-immigrants get a upper hand on this. They are allowing illegals to get an easy path to citizenship.. this will cause a huge influx of people who will benefit the economy but down the line their children will take up the jobs of the americans.. so why a benefit to illegals.
Now you would say that there are so many companies lobbying for the illegals,
true but why don't they listen to the tech lobbyist who are few in number but asking what is actually,legally, abide rulles ly necessary to increase the economy.

I didnt get rebate check this year because i havent filed my wife and kid EAD.
I can apply for their EAD and get SSN so i can get the rebate next year but that costs money too.

I have had this query before. I had an H1B stamping on my passport for a company I never worked for. (Company A)
But, when I applied for a H1B for a different company (Company B). My lawyer asked me if I ever worked for them and received any salary from them ... this was a RFE on my H1B case.
All I did was replied to my lawyer with a negative answer to both questions (worked, salary for Company A).
I got my new H1B approval I guess within 30 days of that RFE reply.
You might want to contact a lawyer to draft a reply to USCIS though. I do not have a copy of the letter to provide to you ... Sorry!

I am not sure how much the next president will affect the passage of the bill through the two houses since they were majority democrat and will continue to be majority democrat. Senate is projected to continue to be majority democrat even after the upcoming election (when 1/3th of the Senate seats are up for election). A Republican president might not veto such a bill. Not sure if Obama would veto a bill which has passed through a democratic majority vote. Just a thought........I could be wrong.

sorry but this is ridiculous. If the US has a skill shortage and wants foreign workers, it should ensure that the foreign worker and his/her family are given the same rights that a domestic workers family enjoys.
If they can't give that right, why do they want to invite the foreign worker at all?
Its true that they are not forcing this on us and we are free to go back anytime. But still isn't the inequality pretty clear here? and this country is supposed to be all about equality...
I agree with you. This policy basically amounts to treating "skilled labor" as some inanimate robots with no emotions or needs whatsoever. If H4 folks are free-loaders, then so are the dependents of EB green card holders .. after all the dependents didnt go through labor cert, did they ? As for the equality hogwash, I have long stopped believing that .. it exists only technically; but reality is what is staring us right now .. retrogression for coming countries with large number of skilled people, backlog "elimination" centers and infinite waits to be given any meaningful rights. Why ? simply because we were idiotic enough to believe all this "meritocracy" and "equality" propaganda.
