EB3 porting is a loophole like labor substitution.
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

As I promised earlier I would keep you guys updated on the process of this case.
On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.
Heres the story. (this guy is a genius)
I asked him how it was possible when my PD wasn't current I got GC approval.
His answer was funny and pleasant. Magic :D
He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.
Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...

There is a lot more Racism in Australia than Canada nowadays as you must have read in the news. Also anyone moving from US to Canada it will be easier to move, as the culture is pretty much the same. Road rules are the pretty similar. But getting a job would be tough compared to australia.

i think this modification of the interpretation of the law is mainly to prevent the massive loss of numbers. I think the DOS now realizes that USCIS cannot effectively handle processing of the massive release of visa numbers in the last quarter, thereby they are doing it in an incremental manner so that the demand is handled effectively (USCIS standards effectively).
I agree; the law definitively leaves no room for error. If all the visas are held back until fourth quarter then there is a significant chance that visas will go unused.
However; it isn't in uscis/dos discretion to make such decisions on a whim for process improvement.
In the orgnizations we work in; there is a big consideration whether the new project or idea is feasible in the current environment. If it isn't then the project/idea gets shelved because it's not doable. However; congress and various regulatory bodies do not give such luxury to uscis. They don't ask them if the implementation of a law or creation of a law will fit into their system or workflow.
At a high level; country quotas in EB do not make a whole lot of sense. I have tried to figure out why they are there; how companies and candidates use EB greencards. Conclusion, I came up with is that in a lot of ways EB is a way to circumvent family base immigration. Many peoples parents have greencards, brothers, sisters, friends, etc; and they realize that it takes too long to get greencard through family base and the fastest way is to come through h-1b and go through EB route. Also; companies; company owners will favor their own people in filing h-1b's and greencards and then you have a situation where certain people are favored due to their nationality or connection. I firmly believe that uscis and the regulatory authorities understand this and hence the reason why there is country quotas.

But honestly, what are the chances for this bill to succeed this year (before election)?

Sen. McCain, a "Maverick" whatever that means, is a close friend to Sen. Lindsey Graham of SC. During the 2007 CIR debate, in the context of skilled immigration, Sen. Lindsey Graham commented - we do not want anymore Indian PHDs coming into US. Sen. Graham was talking about high-skilled immigration in general. Though Mccain supposedly makes his own decisions, the future looks bleak with either candidates.
I think many people on this and other forums would love to see President Obama due to opposition to war and slogan of change, to some extent - myself included. But most of us do not fully know the after-effects on this community. Get ready to feel the wrath of Sen. Durbin. It will get real nasty.

+ its better for the world in general. The last thing we want is more of GWB policies destroying both America's economy, civil rights, and respect in the world.
- his best friend Durbin will again pick up the stick and start beating up on H1 sponsoring. EB will also get run over by the same bus.

Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.

Last update from IV Core about administrative fixes talked about EAD duration being extended to 2 years, but never saw anything about 2 year AP decision (It would have been good though).

If you have a good experience with your lawyer and are recommending the law firm, pls also try to talk to your lawyer about IV. Ask the law firm if they want to contribute/ or even publicize IV to their clients. If they agree to do it, please post here. If they refuse, pls post here.
So when you write about how good your lawyer is, pls also mention if the lawyer supports IV and the help that has been extended to IV.
This will help maintain a list of lawyers who are recommended by members and at the same time, help IV.

Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.
I know this because the very first job I joined, the philosophy at the company was to hire fresh grads (the "get them cheap" works for American Grads too). My boss used to tell me "we can get two for the price of one". The year I got hired, the company recruited 15 new grads (a new "Product Development" dept. was being started) - and I was the only H1B. After 14 months, when the business started picking up, the company did not even bother to raise our pay or even recogonize us. Guess what happened? Over a period of 2 months, 12 of us quit for better jobs. Guess who now had to look for 12 people and at the sametime deliver the product to the clients on time?
If I understand your argument then you can conclude that: faster EB GC processing will decrease wage supression.

OP was never out of status as he was working for one of the employers on proper work authorization all the time. The only question is whether employer X canceled H1 ?Even if they didn't, it is employer's problem not OP's.
Anyways it is better to respond to this query through a lawyer.

I think this guy is from numbers usa for sure. After writing all the BS, he asks it to take it in constructive way. There are lots of other way to express your concern if it had to taken in constructive way. This is definitely not the way.
Based on your comments I could see that you are a regular visitor (FREE RIDER ATTITUDE) to IV site for more than a year. We had several threads crying out for funds in very critical time senstive times. At those times you are a mere spectator and now just for posting this bashing post you reluctantly became a anonymous member. All these shows your LEADERSHIP skills and quality of leading the battle from FRONT. If I were in USCIS I would do a background check on these high qualities and ground breaking positive attitudes even before giving H1.
I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!
That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.
I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!
But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.

Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!
That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.
I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!
But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.
